A graduate of the University of Michigan, Horton came to Kansas in 1860. He began to practice law in Atchison. From 1861 to 1866 Horton was District Judge of the Second District. He was a presidential elector in 1868, U.S. attorney for Kansas, 1869-1873, State Representative from Atchison County, 1873-1875, State Senator, 1876, and Chief Justice of the Kansas Supreme Court, 1877-1895. In 1895 Horton resigned from the Supreme Court to practice law. He died in 1902.

Albert Howell Horton was born in Minnisink, Orange County, N.Y., on Mar., 12, 1837. He began studying law in 1857 in the offices of Joseph W. Gott in Goshen, N.Y. He and a partner, George W. Beebe, opened their practice in 1859 in the Macon-Moscow area of Missouri. Then the partnership moved to Atchison, Kan., in 1860. Albert's public service career began in 1860 when he was appointed city attorney for Atchison. In 1861 Kansas Governor Charles Robinson appointed Horton as Judge of the Second Judicial District where he served until 1866. After returning to private practice for 1 year, Horton was appointed U. S. Attorney for the District of Kansas by President Ulysses S. Grant in 1867. He resigned this position in 1873 and became law partners with Balie P. Waggener in Atchison. In 1877 Horton was appointed the fifth chief justice of the Kansas Supreme Court by Governor Thomas A. Osborn. Horton was reelected to the bench in 1878, 1884, and 1890. He resigned in April 1898, and again joined in partnership with Waggener, this time in Topeka. Horton was politically active throughout his life. In 1868, he was a presidential elector. In 1874 he was elected to the Kansas House of Representatives and in 1876 was in the Kansas Senate when appointed chief justice of the Kansas Supreme Court. As a Republican, Horton tried to stem the People's or Populist Party efforts to control politics in Kansas. Other issues addressed during this time frame were women suffrage, enforcement of prohibition in Kansas, and capital punishment.
